These Terms and Conditions ("Terms", "Agreement") govern your relationship with Educare Skill Academy ("Company", "we", "us", or "our") regarding the use of our services. Please read these Terms carefully before engaging with our services.

3. Acceptance of Terms

By registering for, accessing, or using any service provided by Educare Skill Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

4. Eligibility

You must be at least 18 years of age to register for our services. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian. By using our services, you represent and warrant that you meet these eligibility requirements.

5. Payment Terms

All fees for services must be paid in advance unless otherwise agreed in writing. Payment can be made through methods specified by the Company. Upon successful payment, you will receive a confirmation receipt. All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

6. Refund and Cancellation Policy

6.1 Non-Refundable Policy

All payments made for the Company's services are strictly non-refundable, except under circumstances explicitly outlined in Section 6.3 below. Clients are advised to carefully review service details before making payment.

6.2 Services Rendered

No refunds will be issued for services that have been partially or fully rendered, including but not limited to placement assistance, career counseling sessions, coaching classes attended, training materials provided, or any consultation services delivered.

6.3 Refund Exceptions

A full refund will be issued only if the Company fails to provide the specific service for which payment has been made. In such cases, the client must submit a written refund request within 7 days of the scheduled service date, and the Company will process the refund within 15-30 business days after verification.

6.4 Cancellation by Client

If a client cancels a service after payment, no refund will be provided regardless of the reason for cancellation. Clients are encouraged to confirm their commitment before enrolling or paying for services.

6.5 Change of Mind

Refunds will not be granted if a client changes their mind about a service after payment has been made. All sales are final once payment is completed.

7. Scope and Limitation of Services

7.1 Placement Services

The Company's placement services are designed to assist registered students in securing employment opportunities. Our role is limited to:

  • Facilitating introductions and arranging interviews with potential employers
  • Providing career guidance and interview preparation
  • Sharing relevant job opportunities with registered clients
7.2 No Guarantee of Employment

The Company does not guarantee employment or job placement. Final hiring decisions rest solely with the prospective employer. The Company is not responsible for any aspect of the employment relationship, including but not limited to salary negotiations, job responsibilities, working hours, employment terms, workplace conditions, or any other contractual matters between the client and employer.

7.3 Service Quality

While the Company strives to provide high-quality services, we do not guarantee specific outcomes or results. The effectiveness of our services depends on various factors including client participation, effort, skill level, and market conditions.

8. Client Responsibilities

Clients agree to:

  • Provide accurate, complete, and truthful information during registration and service delivery
  • Attend scheduled classes, counseling sessions, or interviews punctually
  • Maintain professional conduct during all interactions with the Company and prospective employers
  • Comply with all instructions and guidelines provided by the Company
  • Notify the Company promptly of any changes in contact information or circumstances
  • Respect intellectual property rights of training materials provided

9. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be held liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services
  • Errors, omissions, or inaccuracies in service delivery, counseling, or placement assistance
  • Any harm, injury, loss, or damage sustained by clients during travel to interviews, training centers, or workplaces
  • Actions or decisions made by third-party employers or educational institutions
  • Loss of employment opportunities or income due to factors beyond the Company's control
  • Technical issues, internet connectivity problems, or force majeure events

In no event shall the Company's total liability exceed the amount paid by the client for the specific service in question.

10. Confidentiality and Data Privacy

10.1 Client Information

The Company is committed to protecting client privacy. All personal information, documents, and data shared by clients during registration or service delivery will be treated as confidential and will not be disclosed to unauthorized third parties without prior written consent.

10.2 Permitted Disclosures

The Company may share client information:

  • With prospective employers for placement purposes (with client consent)
  • As required by law, regulation, or court order
  • To protect the rights, property, or safety of the Company, its clients, or others
10.3 Data Security

The Company implements reasonable security measures to protect client data. However, no method of transmission or storage is 100% secure, and the Company cannot guarantee absolute security of information.

11. Intellectual Property Rights

All training materials, course content, study materials, presentations, videos, and other resources provided by the Company are the exclusive property of Educare Skill Academy. Clients may not reproduce, distribute, modify, or commercially exploit any materials without express written permission.

12. Code of Conduct

Clients must maintain professional and respectful behavior at all times. The Company reserves the right to terminate services immediately without refund if a client engages in:

  • Abusive, threatening, or disrespectful behavior toward staff or other clients
  • Fraudulent activities or misrepresentation of information
  • Violation of any applicable laws or regulations
  • Damage to Company property or reputation

13. Dispute Resolution

13.1 Amicable Settlement

In the event of any dispute, claim, or controversy arising from these Terms or the services provided, both parties agree to first attempt to resolve the matter through good faith negotiations and mutual discussion.

13.2 Arbitration

If the dispute cannot be resolved amicably within 30 days, the parties may agree to resolve the matter through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

13.3 Legal Jurisdiction

If arbitration is not pursued or fails, disputes shall be subject to the exclusive jurisdiction of the courts located in Bardhaman, West Bengal, India.

14. Modification of Terms

The Company reserves the right to modify, update, or revise these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on our website or notification to clients. Continued use of our services after such modifications constitutes acceptance of the updated Terms. Clients are encouraged to review these Terms periodically.

15. Termination

The Company reserves the right to suspend or terminate services to any client at its sole discretion, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, non-payment, misconduct, or any activity deemed harmful to the Company's interests.

16. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, civil unrest, strikes, power failures, internet outages, or other force majeure events.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Waiver

The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of the Company.

19. Entire Agreement

These Terms and Conditions, together with any written agreements or service contracts, constitute the entire agreement between the client and Educare Skill Academy. This Agreement supersedes all prior discussions, negotiations, understandings, or agreements, whether written or oral, relating to the subject matter herein.

20. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the State of West Bengal. Any legal proceedings arising from these Terms shall be subject to the jurisdiction of courts in Bardhaman, West Bengal.
